This is a notification of an award of a sole source procurement under NAICS code 513210: Software Publishers: This industry comprises establishments primarily engaged in computer software publishing or publishing and reproduction. Establishments in this industry carry out operations necessary for producing and distributing computer software, such as designing, providing documentation, assisting in installation, and providing support services to software purchasers. These establishments may design, develop, and publish, or publish only. These establishments may publish and distribute software remotely through subscriptions and downloads. This will be awarded to Data Innovations for service and support of Instrument Manager Maintenance and Support for the Hopi Health Care Center located in Polacca, Arizona.

This will be for Indian Health Services at the Hopi Health Care Center for one (1) year period under the authority of FAR 6.302-1 Only One Responsible Source and no other supplies or services will satisfy agency requirements. Data Innovations is the manufacturer and sole provider of technical maintenance and support services for DI Products to the Indian Health Service (IHS) for use at IHS sites nationwide. Direct end-users of the software receive support, maintenance and upgrade services. Data Innovations owns all intellectual property rights in the DI Products and does not support third-party technical services.

If you can provide the services requested, all responsible sources may submit a capability statement, which shall be considered by the Agency and may be e-mailed to Michele.Lodge@ihs.gov referencing notice number PHX-SS-23-015 by 10AM, 13 April 2023. A determination by the Government not to compete this proposed contract acquisition based upon responses to the notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. This notice does not obligate the Government to award a contract or otherwise pay for information provided in response. The Government reserves the right to use information provided by respondents for any purpose deemed necessary and legally appropriate. Any organization responding to this notice should ensure that its response is complete and sufficiently detailed. Information provided will be used to assess tradeoffs and alternatives available for the potential requirement and may lead to the development of a solicitation. Respondents are advised that the Government is under no obligation to acknowledge receipt of the information received or provide feedback to respondents with respect to any information submitted.
