Description

This is a combined synopsis/solicitation for commercial products or commercial services prepared in accordance with the format in FAR subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. Solicitation # RFQ-23-PHX-005 is issued as request for quotation (RFQ). This combined synopsis/solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular FAC 2023-01 dated 01 December 2022.



The Department of Health and Human Services, the Phoenix Area Indian Health Service (IHS), is soliciting quotes for a GE NextGen LogiQ e Ultrasound System brand name or equal.



This requirement is under North American Industrial Classification Standard (NAICS) codes: 423450 or any applicable NAICS code, along with the appropriate Small Business Size Standard.



Set-aside: 100% Indian Small Business Economic Enterprise (ISBEE)



This requirement is a 100% set-aside for Indian Small Business Economic Enterprises (ISBEE). In accordance with HHSAR 352.226-7, ISBEE vendors must complete the attached INDIAN HEALTH SERVICE BUY INDIAN ACT INDIAN ECONOMIC ENTERPRISE REPRESENTATION FORM. All firms or individuals responding must be registered with the System for Award Management (SAM).





SUBMISSION INSTRUCTIONS



Proposals/Quotes must be submitted electronically via email to suzanne.schumacher@ihs.gov on or before the Request for Quote (RFQ) closing date and time.



Quote(s) must be FOB destination, include all applicable discounts, and all required line items must have a price to be considered for award. Not providing prices for all CLIN items shall make your offer non-responsive to the solicitation. Quotes may be attached in a vendor preferred format (e.g. PDF).



Offerors shall quote on all required items. The government will not split this requirement. If Microsoft Excel is used for a quote, unit prices are to be rounded to no more than 2 decimal places.



The Government anticipates award of one (1) Firm Fixed Price (FFP) contract resulting from this solicitation to the Lowest Price Technically Acceptable (LPTA) offer as defined by the evaluation factors and sub-factors in FAR 52.212-2 below.





REQUIREMENT



This procurement is for NEW Equipment ONLY; no remanufactured or "gray market" items. The price quote is to be submitted as an all-inclusive FFP quote for one (1) NextGen LOGIQ e Ultrasound System brand name or equal with the following salient features:




  1. Needle recognition with 2 types of ultrasound for the ability to separate needle appearance versus tissues. To be used with dry needling for precise perineural and musculoskeletal targets. This will improve accuracy and quality of patient care and will assist in future research projects. This feature must be available on all linear and convex probes.

  2. Simultaneous split screen in order to make the comparison of Right and Left anatomy or pre and post images for clinical decision making.

  3. High resolution display for accurate reading of images. Extended field of view imaging capability that allows viewing and measurement of anatomy that is larger than would fit in a single image possible. This will render a panoramic image up to 60 cm, in long axis and can allow visualization of a wider field of view for comparing normal to abnormal anatomy.

  4. Virtual Convex imaging feature providing a wide field of view so users can visualize more anatomy in a single scan in the far field. Feature to be available on all linear probes

  5. Patient follow-up tool with fusion that will help ensure technical consistency from exam-to-exam. This will help clinical conclusions not be clouded by inconsistent technique. This feature can automatically recall the imaging parameters, comments and body patterns to be identical to your previous exam. Provides an alert if you use a different transducer than last time.

  6. Ability to calculate and label measurements.

  7. Compact and portable with battery in order to move between treatment rooms and various clinics within outpatient services and inpatient roofs if needed. Though compact and portable, will still need to be able to attach at least 3 transducers at a time and have ample battery life.

  8. User programmable preset capability multiple users.

  9. Button probe so that a single clinician can perform procedures while controlling multiple parameters of the system from the probe without breaking the sterile field instead of requiring assistance from second person.

  10. Must have the ability to switch between multiple transducers to visualize anatomy at varying depths, angles, and widths. The machine must be able to switch between transducers without having to break sterile field, without requiring detachment and attachment of individual probes during procedure, and without requiring assistance of second person.

  11. 3D image capability using any transducer to show anatomical relationships between anatomical structures

  12. Transducers must be able to visualize musculoskeletal anatomy in joints, hand, foot, abdomen, and perineum for orthopedic, neuromuscular, and pelvic/women’s health considerations.

  13. High-Res PDI technology to visualize flow in neovascularization for use alongside outpatient wound care services. Hemodynamic visualization can also aid in detecting DVT in patients especially following total joint arthroplasties.

  14. Able to upload information into patient’s EHR.

  15. Cybersecurity features to protect patient information

GRAY MARKET EQUIPMENT




  1. Gray market items are Original Equipment Manufacturer’s (OEM) goods sold through unauthorized channels in direct competition with authorized distributors. This procurement is for new OEM equipment. No remanufactures or gray market items will be acceptable.

  2. Vendor shall be an OEM authorized dealer, authorized distributor or authorized reseller for the proposed equipment and/or services such that the OEM’s warranty and service are provided and maintained by the OEM. All warranty and service associated with the equipment shall be in accordance with the OEM terms and conditions. All Equipment must be covered by the manufacturer's warranty.

  3. The delivery of gray market items to the IHS in the fulfillment of an order/award constitutes a breach of contract. Accordingly, the IHS reserves the right to enforce any of its contractual remedies. This includes termination of the contract or, solely at IHS’s election, allowing the Vendor to replace, at no cost to the Government, any remanufactured or gray market item(s) delivered to an IHS medical facility upon discovery of such items.

52.212-2 EVALUATION COMMERICAL ITEMS (Nov 2021)



(a) The Government will award a Firm Fixed Price (FFP) Lowest Price Technically Acceptable (LPTA) resulting from this solicitation to the responsible offeror whose offer conforms to the solicitation. The following factors shall be used to evaluate offers. Factors and Technical acceptability factors are on a pass/fail basis.




  • Price: The price(s) shall be specific, complete in every detail, and separate from the technical submission. Submit pricing for all; not submitting pricing for all items will make your quote non-responsive to the solicitation. Contractor shall state in their RFQ that the quote shall remain effective for 60 calendar days after close of solicitation. The lowest evaluated price of proposals meeting or exceeding the technical acceptability standards shall be the successful offer.

  • Technical acceptability is based on the following subfactors:

    • Technical Capability of the Item Offered – Offerors shall provide brief description of technical characteristics and specifications of the item stated in this solicitation, to include technical documentation to support equipment being offered. If equal items are quoted, a crosswalk or detailed list of specifications that are the same as the salient characteristics of the items needs to be included.

    • Delivery - Contractor shall submit a proposed delivery ARO for this requirement

    • Product requirements - The contractor shall provide new condition devices and accessories. All equipment listed within this procurement shall be produced by the Original Equipment Manufcaturer (OEM). The Offeror shall provide certification at the time of solicitation that indicates the Offeror is a fully authorized distributor/dealer for all Manufacturer Products. The products distributed to the Offer by OEM shall be guaranteed to be safe, maintained in adequate storage conditions, and that any/all warranties and services and/or preventative maintenance agreements are transferred and will be honored by the OEM. No gray market, counterfeit or adulterated devices shall be accepted.

    • Capacity - The Contractor shall abide by ANSI/AAMI EQ56:2013 (Recommended practice for a medical equipment management program).





Technical and past performance, when combined, are N/A.



(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).



(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.



(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.



(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.



(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

HHSAR 352.226-7 Indian Economic Enterprise Representation



(a) The offeror must represent as part of its offer that it does meet the definition of Indian Economic Enterprise (IEE) as defined in HHSAR 326.601 and that it intends to meet the definition of an IEE throughout the performance of the contract. The offeror must notify the contracting officer immediately, via email, if there is any ownership change affecting compliance with this representation.



(b) The representation must be made on the designated IHS Indian Economic Enterprise Representation form or any successor forms through which the offeror will certify that the ownership requirements defined by HHSAR 326.601 are met.



(c) Any false or misleading information submitted by an enterprise when submitting an offer in consideration for an award set-aside under the Buy Indian Act is a violation of the law punishable under 18 U.S.C. 1001. False claims submitted as part of contract performance are subject to the penalties enumerated in 31 U.S.C. 3729 to 3731 and 18 U.S.C. 287.

HHSAR 352.232-71 Electronic Submission of Invoice Payments (FEB 2022)



(a) Definitions. As used in this clause—



“ Payment request” means a bill, voucher, invoice, or request for contract financing payment with associated supporting documentation. The payment request must comply with the requirements identified in FAR 32.905(b), “Content of Invoices” and the applicable Payment clause included in this contract.





(b) Except as provided in paragraph (c) of this clause, the Contractor shall submit payment requests electronically using the Department of Treasury Invoice Processing Platform (IPP) or successor system. Information regarding IPP, including IPP Customer Support contact information, is available at www.ipp.gov or any successor site.





(c) The Contractor may submit payment requests using other than IPP only when the Contracting Officer authorizes alternate procedures in writing in accordance with HHS procedures.





(d) If alternate payment procedures are authorized, the Contractor shall include a copy of the Contracting Officer's written authorization with each payment request.

Unless further changes are required, the Department of Health and Human Services shall notify the Contractor of the effective date of the clause at HHSAR 352.232-71 Electronic Submission of Payment Requests by providing written notice to the Contractor within thirty (30) days of implementing the HHS Electronic Invoicing Implementation Project (E-Invoicing) and within thirty (30) days of the anticipated finalization of the clause at HHSAR 352.232-71 Electronic Submission of Payment Requests, via public special notice issued through the SAM.gov portal. However, for purposes of this award or modification, the effective date shall be the date signed by the parties.
