1. INTRODUCTION





Title: Blanket Purchase Agreement (BPA) for the Customs and Border Protection (CBP), U.S. Border Patrol Headquarters, Tucson Sector Migrant Detainees Snack Food requirement.





Location: U.S. Border Patrol (USBP) Tucson Sector area of operations.





This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.603(c), and in accordance with FAR Part 13.303, as supplemented with additional information included in this notice. This announcement is for a single award Blanket Purchase Agreement (BPA) and constitutes the only solicitation; quotations are being requested and a written solicitation will not be issued. The solicitation number is 70B03C23Q00000128 and is issued as a Request for Quotation (RFQ). The solicitation document and incorporated provisions and clauses (including Attachment Two to the solicitation) are those in effect through Federal Acquisition Circular 2023-02. The associated NAICS code for this procurement is 311991 – (Perishable Prepared Food Manufacturing) with a small business size standard of 500 Employees. This requirement is a total Small Business set-aside, and only qualified vendors should submit quotes for consideration. Prospective quoters are required to identify their company’s business size and certify that they hold the applicable NAICS code.





To be eligible to submit a quote, prospective quoters must have a valid and up-to-date applicable registration in the System for Award Management (SAM) website (www.sam.gov) prior to proposal submission. Prospective quoters not properly registered in SAM at the time of quote submission shall not be considered for award.





The deadline for receipt of quotes is: Tuesday, June 6, 2023 at 10:00 AM Pacific Daylight Time (PDT).





Quote submissions must be submitted only by email to Contract Specialist Christopher Shaw at: christopher.j.shaw@cbp.dhs.gov Subject line of the email should read: 70B03C23Q00000128 Quotation Submission: USBP Tucson Detainee Snack Food All proposal pricing must be valid for up to 60 calendar days after close of the solicitation.





Interested vendors must submit any questions concerning the solicitation at the earliest time possible to enable the Government to respond, but no questions shall be accepted after Monday, May 31, 2023 at 10:00 AM PDT may not be considered. Questions must be submitted directly to the proposal submission point of contact as indicated above.





Description of the Requirement





The U.S. Customs and Border Protection (CBP), United States Border Patrol (USBP) Tucson Sector has a requirement for a bulk Snack Food BPA for migrant detainees held in custody by the USBP Tucson Sector while they await adjudication or transfer. The requirement is to have pre-packaged snacks delivered to the locations as outlined, for distribution by the Government as needed. The contractor shall provide all labor, materials, supervision and transportation necessary to deliver pre-packaged ready-to-eat snacks in the sizes and types required. Snacks are required at the USBP locations identified in the attached Statement of Work (SOW).





The US Customs and Border Protection Agency intends to establish one (1) single-award BPA resulting from this requirement, based on the requirements as outlined in the solicitation documentation. However, the Government reserves the right to not award any BPA and, if a BPA is awarded, the Government will not be obligated to make any purchases on the award. The resultant BPA award will be one-year in duration, subject to an aggregate total Not-To-Exceed ceiling/Maximum Call Order Value amount as follows: $500,000.00.





The Government anticipates award of a BPA within 30 days of receipt of offers. The Government is obligated only to the extent of any authorized Call Order placed under the BPA.





BPA Ordering Period





The ordering period of the BPA shall be one-year or up to the Maximum Ceiling Value, whichever limit is reached sooner. Pricing quotes shall be provided for the 1 year period only, as follows:





9 June 2023 to 8 June 2024





2. GENERAL INSTRUCTIONS FOR THE PREPARATION OF QUOTES





CBP will conduct a streamlined evaluation of all received quotes for establishing the BPA, as outlined in the attached BPA Solicitation Provisions and Clauses document, the content of which is incorporated herein by reference. CBP reserves the right to establish a BPA without further communication and exchange; therefore, each response to this request should contain the Quoter’s best pricing, terms, and conditions. Quotes must be prepared in accordance with these instructions and provide all required information in the format specified. The required format is designed to ensure submission of information essential to the understanding and comprehensive evaluation of the Quoter’s quote. Failure of a quote to comply with these instructions may be grounds for exclusion of the quote from further consideration. Any exceptions taken with respect to the clauses in the solicitation shall be noted by the Quoter in its proposal. For the purpose of facilitating exchanges, for every instance where the Quoter does not propose to comply with or agree to a requirement, the Quoter shall propose an alternative and describe its reasoning therefor.





Each prospective Quoter shall include in its quote a fully completed BPA Pricing Sheet using the template attached to this notice. Failure to comply with this term may result in the quote being determined to be non-responsive.





In addition to providing pricing for this solicitation, each Quoter must also provide any required, NON-PRICING responses as follows:






  1. Technical Proposal (10 pages maximum): Full menu of items to be provided; Distribution methodology; Food Safety Plan/Quality Control Plan; Completed representations and certifications; Certification that quoted menus meet or exceed USDA and FDA nutritional guidelines; Business health certifications.






  1. Past Performance (5 pages maximum): Information on historical provision of same or similar requirements. Offerors shall identify up to three (3) contracts/orders or subcontract work where the Offeror has performed similar requirements in the past three (3) years. These projects/contracts/orders/subcontracts can include those performed for the federal, state, and local governments, commercial industry and those performed for private organizations.





Submissions shall be in electronic format and sent to the BPA Contract Specialist listed on this solicitation in accordance with this solicitation.





Emailed submissions must be in separate attachments and clearly indicate what is being provided. The Government reserves the right to disregard any additional attachments without notification to any Quoter. Subject line of the email should read “70B03C23Q00000128 Quotation Submission: USBP Tucson Detainee Snack Food.”





Due to CBP restrictions on the size of email, ensure that all emails submitted are less than 5MB. If the offer exceeds 5MB, please separate the submission into multiple emails and include in the subject line the solicitation number and # of # emails. Any electronic submission determined to contain a virus will be deleted and not viewed or accepted for consideration under this solicitation.





Submissions must be received no later than the exact time specified in this solicitation to be considered for award. Time of receipt will be determined by the government’s email receipt time. It is the offering firm’s responsibility to ensure this is done according to the above restrictions.





Offers MUST be good for 30 calendar days after close of solicitation.
