The Navajo Area Indian Health Service, Chinle Comprehensive Health Care Facility, Chinle, AZ intends to award a non-competitive, sole source task/delivery order against Federal Supply Schedule contract V797D-60637 as BPA to proposed contractor, Ortho Clinical Diagnostics. Sole Source authority cited FAR Part 8.405-6 (a)(1)(i)(B) - Only one source is capable of providing the supplies and services required at the level or quality required because the supplies and services are unique or highly specialized. The Proposed Contractor shall renew annual leasing agreement for (2) 7600 integrated chemistry systems (already on-site), consumables, supplies, test reagents to the Laboratory Department at the Chinle Comprehensive Health Care Facility (CCHCF), period of performance 05/01/2024 to 04/30/2025.

The systems shall have capability of performing chemistry tests and immunoassay testing on same analyzer platform.

Analyzers must not require any type of water connection to perform testing or require electrodes to perform electrolyte testing. Billing for instrument lease will be based on annual volume of tests performed through “as needed” reagent purchases.

The Proposed Contractor is the only organization uniquely qualified to provide the required services to ensure there is no interruption in services that will negatively affect direct patient care. The Proposed Contractor’s equipment is currently on-site, fully installed, and is currently being used by laboratory staff to provide direct patient care testing services. Changing out systems would negatively impact patient care.

This notice of intent to award a sole source contract is not a request for competitive proposals. There will be no solicitation available for competitive quotes. Any response to this notice must show clear and convincing evidence, that competition would be advantageous to the Government. Respondents are advised that the Government is under no obligation to acknowledge receipt of the information received or provide feedback to respondents with respect to any information submitted. Last day to provide affirmative written response is November 14, 2023, 5:00PM MDST.

A determination by the Government not to compete the proposed procurement base upon responses to this notice is solely within the discretion of the Government. Information received will be considered solely for determining whether to conduct a competitive procurement in the future. Any solicitation resulting from the analysis of information obtained will be announced to the public in Federal Business Opportunities in accordance with the FAR Part 8.4. However, responses to this notice will not be considered adequate responses to a solicitation. No proprietary, classified, confidential, or sensitive information should be included in your response. The Government reserves the right to use any non-proprietary technical information in any resultant solicitation(s).
